Whiz Limited Summery Academy 2026 Terms & Conditions
DEFINITIONS
- The ‘Company’ refers to Whiz Limited, a Limited Liability Company (Company registration Number C 71655) Registered Office 38/8 Mark Apartments,Triq Karm Zerafa, Birkirkara, Malta.
- The ‘Organisers’ refers to the organisers of the activities organised by Whiz Limited, who shall be selected at the sole discretion of the Company’s directors.
- The ‘Programme’ refers to the list of activities. (Parents Brochure – will be sent via email couple of days/weeks before the start of the Whiz Summer Academy).
- A ‘Parent’ is any person who has the authorisation to sign the Application Form and the Parent Consent Form either because such Parent is the biological mother or father of the child and/ or because he or she has been duly charged with the care and custody of such child under the Laws of Malta.
- A ‘Student’ is any child who shall attend the activities organised.
- These Terms and Conditions reflect the custom and practice of Whiz Limited, a Limited Liability Company, created with the objective of entering the business of entertainment for children and adults alike, by designing, organising, managing and performing both indoor and outdoor activities.
- Whiz Limited is responsible for the daily running of the Company and for the organisation of the Programme which Parents can apply for on behalf of a Student by submitting the Application Form.
- The Company is directed towards the happiness, success, safety and welfare of each Student and the integrity of the community.
- These Terms and Conditions shall govern the relationship between the Parent/Guardian and the student, and Whiz Limited, which is governed exclusively by Maltese Law, and any dispute arisingas a result of such relationship is to be referred to the Courts of Malta.
APPLICATION & RUNNING OF THE PROGRAMME
1. To express their consent, Parents must fill in and read the application package on https://whiz.com.mt/product/summer-academy-2026/
- The Application Form must be filled and paid online.
- The applications are accepted on a first come first serve basis. Whiz Limited will close all applications once the service’s capacity is reached. Any late applications may be sent on Whiz Mobile (+356 79211711) and a waiting list is created.
- The starting time of the service on the application is the time that all students are to be at the Hub. Service at the particular event starts later taking into consideration the travelling time from the Hub to the event location.
- Students’ attendance for the excursions/activities included in the Whiz Summer Academy is the responsibility of the Parents/Guardians.
- The Company’s Summer Academy Programme is not a contractual document and can be changed from time to time according to circumstances.
- Whiz Limited, like any other company, may undergo several changes in management and organisation from time to time.
- Before authorising their children to participate in the excursions/activities included in the Programme organised by the Company, Parents shall read all the information related to the excursions/ activities, which may be found in the Parents Brochure(Parents Brochure – will be sent via Whatsapp a couple of days/weeks before the start of the Whiz Summer Academy).
- The Organisers reserve the right to make some minor changes to the planned events/activities even after payment due has been made by Parents. In such cases the Parents must be notified in due time.
- The programme will open subject to the demand. Whiz Limited retains the right not to provide the service if the required quota is not reached.
- By enrolling the child in the programme, parents acknowledge that certain activities and events are facilitated by external third-party suppliers. In addition to these Terms and Conditions, parents/guardians must agree to the specific terms and conditions of all such suppliers and duly sign any required liability waivers. Whiz Limited reserves the right to exclude any child from an event or activity if the necessary supplier documentation has not been completed and returned. In the event of such exclusion, no refunds, credits, or fee adjustments will be provided for the missed event.
CARE AND CUSTODY
1. The Parents must, in the Application, disclose to the Company, any known medical condition, or allergy affecting the Student, any history of a disability and/or any other neurodiversity on the part of the Student, or any family circumstances or court order which might affect the student’s care, welfare or happiness, or any concerns about the Student’s safety.
- Whiz Limited regards each child’s privacy as important and hence, Whiz will seek to comply with the provisions of the GDPR, Chapter 586 of the Laws of Malta. To this end, Whiz ensures that:
- Personal data is processed fairly and lawfully;
- Personal data is processed with good practice.
- The collected personal data has been collected for the specific, explicitly stated, and legitimate purposes indicated;
- The collected personal data will not be processed for any purpose that is incompatible with that for which the information has been collected;
- The collected personal data will be kept for a period of 1 year following the termination of service by the parent or the ending of a specific programme;
- Personnel managing this data is bound by confidentiality.
- By submitting the application form, the parent/guardian acknowledges that Whiz Limited will have access to all the provided data and subsequently consent to such use.
- Whiz Limited, apart from deeming each child’s privacy as crucial, seeks to be adherent to the provisions of Chapter 586 of the Laws of Malta at all times. To this end, Whiz Limited informs that all children’s data may be disclosed to third parties, including, but not limited to, departments that are directly associated with child protection matters, relative stakeholders, medical bodies, and/or other bodies. At certain points, it may be necessary to disclose information in order to comply with any legal obligations. Whiz Limited takes all reasonable steps as required by law in order to ensure the safety, privacy and integrity of the disclosed information, and, where necessary and appropriate, enter into contracts with such third parties to fully protect the privacy and integrity of any information supplied.
- All data given by the Parents about the Students should be correct and up to date. In the eventuality that it results that the provided data is incorrect and/or not up to date, the Parents/guardians, will be bound to shoulder all responsibility for any ensuing circumstances due to the same incorrectness and/or inaccuracy. It is the responsibility of the parent(s)/guardian to make full disclosure to Whiz Limited Management of any special circumstances and/or particular needs which may affect the ability of their child to participate fully in the programme. Service may be terminated at the Company’s discretion and no refund will be issued.
- It is assumed that the parents listed on the application are authorised to pick up the child from the Hub. Additional persons or changes are to be communicated, in writing via email to the Head of Operations & Inclusion (j.grech@whiz.com.mt) within a week before the needed change. Whiz Limited does not assume responsibility in this matter and any adult picking up children from the Hub is assumed to do so legally and with the full consent of both parents/guardians.
- With the exception of communication regarding cancellation, any communication made by the parents with the Organisers will be treated as to have been done so on behalf of the Student.
- In the case of a Student with a statement of needs, parents may be requested to submit a copy of the Statementing Report, the Psychological Report, and the Individual Education Programme (IEP), to Whiz Limited. Other documents or guidance from professionals may be requested based on the strengths and needs profile of each student. Failure to present such information may result in immediate termination of service without refund.
- In the case of children who exhibit continuous challenging behaviour, the parents may be contacted and requested to attend to the needs of their child. It is agreed that all parties would do their utmost to be proactive and avoid the behaviour. Failure by parents to do so may result in termination of service without refund.
- Whiz Limited will not tolerate parents/legal guardians who leave their children at our care after the end of service, unless in extreme and emergency situations.
- A late pick-up fee of €50 will be charged if children are picked up after the closing time. A 15-minute grace period will be provided. However, consistent late pick-ups will lead to the suspension of our services. No refund will be issued.
- Parents/guardians of any child requiring the administration of emergency medication during attendance at the service must disclose this requirement at the time of application by sending an email to the Head of Operations & Inclusion (j.grech@whiz.com.mt). All procedures and protocols prescribed by Whiz Limited must be strictly adhered to at all times.
- Parents/guardians of any child requiring medication to be administered during attendance at the service must declare this requirement at the time of application by sending an email to the Head of Operations & Inclusion (j.grech@whiz.com.mt). All relevant procedures and protocols established by Whiz Limited must be strictly adhered to at all times. Not giving prescribed medication is not an option, unless instructed to do so by a medical doctor.
- It is a custom and practice of the Company to include some photographs or images of Students in the Company’s promotional material, such as, but not limited to, the Programme itself. The Company, however, will not disclose the name or home address of a Student without the parents’ consent.
- Parents who do not want such photographs or images of their child to appear in any of the Company’s promotional material must refrain from signing the ADVERTISING/PROMOTIONAL USE PHOTO CONSENT FORM provided with the application or by the Company at any time.
- The ratio of adults to Students during the excursions/activities will be that required by law at the time of the Programme, as this requirement may change from time to time as per the Laws of Malta.
- Whenever a Student requires the assistance of a Learning Support Educator, Whiz Limited collaborates with the parents to be able to provide this service, but this is always at the discretion of Whiz Limited and provided with the best intentions and a high level of care towards the child. The student may be required to delay his/her service until all preparations are made to ensure the students’ safety, enjoyment and participation during
- Nevertheless, the presence of a Learning Support Educator does not, in any manner whatsoever, diminish or reduce the responsibility of the Organisers or of the adults assisting the Students during the excursions/activities.
- The Parents consent to the Student travelling by any form of public transport and/or in a motor vehicle driven by a responsible adult who is duly authorised and insured to drive a vehicle of that type.
- Students are responsible for the security and safe use of all their personal property including but not limited to money, mobile phones, media players, watches, computers, calculators, musical instruments, backpacks and sports equipment, and for property lent to them by the Company.
- Unless negligent or guilty of some other wrongdoing causing injury, loss or damage, the Company does not accept responsibility for accidental injury or other loss caused to the Student or Parents, or for loss or damage to property.
- Parents give their consent to physical contact as may be in line with good practice, such deemed to be appropriate and proper for teaching and instruction, and for providing comfort to a Student or maintain safety and good order, in relation with the Student’s health and welfare.
CANCELLATION OF BOOKINGS AND REFUNDS
- Parents that authorise the Student to attend any excursion/activity included in the Programme may freely cancel their booking.
- Any cancellation must be done in writing by sending a letter in writing to the stipulated address laid down in the application form. This must be done at least two weeks prior to the first day of the first excursion/activity of the Programme.
- Parents that cancel their activity in the manner laid down in (2.) will be refunded the price of the application paid.
- Any cancellation done within two weeks of the first excursion/activity of the Programme must be accompanied by a valid reason for cancellation.
- The Organisers have the full liberty not to refund the price paid when cancelling in the manner laid down in (4.).
- Where the reason for cancellation is that of sickness and such application is made within two weeks of the first excursion/ activity of the Programme or when the Programme is ongoing, this must be accompanied by a medical doctor’s certificate. Nevertheless, the Organisers still have the discretion not to accept to refund the price paid upon application.
- If for any reason a refund is to be issued, an administration fee of €25 will be deducted directly from the refundable amount.
- All excursions/activities forming part of the Programme may be postponed. Thus, where an event was planned to be held on a particular day but for various reasons including but not limited to bad weather, strikes or labour disputes, casualty, or any other unforeseeable circumstances, such that theevent cannot take place on that particular day, then that event shall take place on another day.
- The amount of excursions/activities laid down in the Programme must all take place and the Organisers have no right to cancel any activity without replacing it with another activity. Thus the number of excursions/ activities laid down in the Programme must be the same amount of excursions/ activities which take place.
- Where a Student chooses not to attend a particular excursion/ activity laid down in the Programme, Parents may not be refunded part of the total price paid, or for that excursion/activity.
- Unless a valid reason is put forward, Parents may not withdraw their application,and may not be refunded.
- The point laid down in (11.) applies even in those circumstances where the Student does not attend the majority of the excursions/activities.
HEALTH AND MEDICAL MATTERS
- The Company may at any time require a medical opinion or certificate as to the Student’s general health where it considers is necessary as a matter of professional judgement in the interests of the Student and/ or the Company.
- By submitting the application, you are giving your permission for the opportune First Aid treatment to be administered to your child by qualified personnel. The Parents authorise the Company to consent on their behalf to the Student receiving emergency medical treatment at Malta’s government run hospital, Mater Dei or any other emergency medical facility, whereas ambulance or rescue squad members would be authorised to administer all necessary treatments. Permission is given for the child to be examined by a qualified medical practitioner as deemed necessary by the hospital, this, for the Student’s welfare and if the Parents cannot be contacted in time or the matter of urgency is deemed too great.
- The welfare of all children is our utmost priority. In the event that a child sustains an injury or develops a medical condition, and a licensed medical practitioner provides a written opinion that it is unsafe for the child to participate in or continue with the programme, the child’s enrolment will be terminated on medical grounds. Fees paid for the programme are non-refundable in such circumstances, regardless of the point in the programme at which the medical opinion is provided.
BEHAVIOUR AND DISCIPLINE
1. The Company gives great importance to courtesy, integrity, good manners, good discipline, and respect for the needs of others. Parents agree that their Students will fully take part in the activities, will be punctual, will be well-behaved and will comply with the rules established by the Organisers. Non-compliance with our policies and procedures, or any form of aggressive, abusive, or otherwise inappropriate behaviour towards any person within the Whiz community, may result in immediate suspension or permanent termination of services, at the sole discretion of Whiz limited.
2. Parents agree that their Students will not participate in any of the following behaviours/activities;
- Bullying or harassment of other participants through any means including messaging, calls, or multimedia.
- Accessing, sharing, or viewing explicit, pornographic, or otherwise inappropriate content.
- Recording or capturing video or sound footage without express permission.
- Engaging in any type of illegal or unauthorised activities according to the Laws of Malta.
- The Company is not liable for any damage which the Students may do to property belonging to third parties.
- Except as required by Maltese law, the Company shall not be required to divulge to Parents or others, any confidential information or the identities of the Students.
- The Company operates a zero tolerance policy on the misuse or possession of drugs and illegal substances.
- Students found to be in possession of drugs and/or illegal substances, orfound to be in breach of any of the prohibitions and rules as mentioned above, may be prohibited from attending any future excursions/activities organised by the Company. In such circumstances, any price of future excursions/ activities paid by the Parents to the Company will not be refunded.
USE OF MOBILE PHONES AND TECHNOLOGICAL DEVICES
- General Prohibition: The use of mobile phones, tablets, and other technological devices is strictly prohibited during Event services provided as part of the Whiz Summer Academy 2026 and during all events organised by Whiz Limited.
- Should a participant be found violating the policy above (1.);
- The device will be confiscated immediately by the driver/Transport Supervisor during transport or by the Team Leader during events.
- The device will be securely stored and returned only at the conclusion of the transport route or the event, and a report will be logged.
- Going against this policy is considered as a serious offence and may result in prohibition from attending any future excursions/activities organised by the Company. In such circumstances, any price of future excursions/activities paid by the Parents to the Company will not be refunded.
- Parents/Guardians will be notified, if the device is confiscated during transport, by the Transport Coordinator, or if the device is confiscated during an event, Whiz Limited will notify the parent or guardian promptly.
- Repeated violations or any use of devices for reasons of, but not limited to bullying, accessing inappropriate content, or illegal activities, may result in suspension or termination of the participant’s enrollment in the Whiz Summer Academy 2026. In such cases, no refunds will be issued.
- Whiz Limited is not liable for any inappropriate or unauthorised use of mobile or technological devices by participants during events. Responsibility for the participant’s adherence to this policy rests solely with the parent or guardian.
- By enrolling a child in the Whiz Summer Academy 2026, parents or guardians acknowledge and agree to this policy regarding mobile and technological devices. They also agree to discuss and enforce these rules with their child to prevent violations.
- Whiz Limited reserves the right to amend this clause at any time to enhance the safety and well-being of all participants.
TRANSPORT SERVICE PROVIDER
Transport Terms and Conditions for Whiz Summer Academy 2026
These Terms and Conditions (“Terms”) govern the transport services provided in collaboration with Off We Go Transport Limited (“Transport Provider”) for the Whiz Summer Academy 2026. By opting for transport services, you agree to the following terms:
- Transport Service Overview
1.1. Transport services are subcontracted to and fully managed by Off We Go Transport Limited. All responsibilities for transport management, logistics or execution will be handled by the team of Off We Go Transport Limited.
1.2. All queries, issues, payments, or concerns related to transport must be directed to Off We Go Transport Limited.

- Transport Logistics and Supervision
2.1. Base to Event Location:
- Transport will depart from the Base at 8:15 am. Late arrivals at the Base will result in parents having to make alternative arrangements. Off We Go Transport Limited and Whiz Limited will not be held liable for any damages or inconvenience caused by late drop-offs.
- Transport supervisors will supervise the vans only from the Base to the Event Location and from the Event Location back to the Base.
2.2. Event Location to Base:
- Return transport will arrive at the Base at approximately 1:00 pm
2.3. Comfort and Facilities:
- All vans will have air conditioning (AC) systems running throughout the duration of the transport route to ensure student comfort.
2.4. Door-to-door transport services may be available, subject to the following:
- Availability: This service is provided at the sole discretion of Off We Go Transport Limited.
- Restrictions: Certain areas, including narrow alleys, rural locations, or outskirts, may hinder door to door service provision. Parents in affected areas must coordinate alternative arrangements with the Transport Provider.
- Behavioural Conduct
3.1. Children must remain seated and wear seatbelts throughout the journey, regardless of age, as required by law. Off We Go Transport Limited will not be held liable for any damages or injuries resulting from children failing to remain seated or wear seatbelts. Additionally, the company accepts no responsibility for damages to equipment caused by negligence during the journey.
3.2. Misconduct, bullying, or other behavioural issues will be addressed by the Transport Provider or Whiz Team members (Transport from base to Event Location and from Event Location back to the base). Persistent issues may result in suspension or exclusion from the transport service without a refund.
3.3. The use of mobile phones during transport is prohibited in accordance with Whiz Limited rules.
- Mobile Phones and Technological Devices:
- The use of mobile phones, tablets, and other technological devices is strictly prohibited during transport.
- Children found using such devices, including but not limited to making calls, taking videos, or sound recordings, will be subject to disciplinary action.
- Any video or sound recordings taken on the transport service may constitute a breach of privacy and will be dealt with accordingly. Repeated infractions may lead to suspension or termination of the transport service without any refund.
- Prohibited Behaviour: Bullying, foul language, disruptive behaviour, or any form of misconduct will not be tolerated.
- Disciplinary Measures:
- In cases of misconduct, including but not limited to bullying or the use of inappropriate language, the matter will be addressed promptly by the transport driver (when door to door transport service is in operation) or transport supervisor (when Transport Service is from base to Event Location and from Event Location back to the base).
- Severe or repeated offenses may result in immediate suspension or termination of the transport service for the offending child. In such cases, no transport service refund will be issued. Parents will be required to make other arrangements for the child to be able to attend the event.
- Accountability: Off We Go Transport Limited is committed to ensuring a safe and respectful environment during transport. All disciplinary actions related to transport services will be coordinated and enforced by Off We Go Transport Limited.
5. Parent Responsibilities
5.1. Parents are responsible for ensuring their children are ready for pick-up at the allocated time and location.
5.2. Drivers will provide approximate pick-up times (door to door service) a week before the Whiz Summer Academy starts. A two-minute waiting policy will be enforced to avoid delays. Off We Go Transport Limited is not liable for missed pick-ups due to non-compliance with these timings.
5.3. Parents are required to review and accept the Transport Provider’s Terms and Conditions directly via their website.
6. Liability and General Disclaimer
6.1. Whiz Limited is not liable for any incidents, delays, damages, or disputes arising from the transport services provided by Off We Go Transport Limited.
6.2. Any claims, including those related to misconduct, misbehaviour, or acts by the transport staff or other students during transport service, must be directed to Off We Go Transport Limited.
6.3. The transport service, including all logistics and personnel, is solely under the responsibility of Off We Go Transport Limited.
7. Additional Conditions
7.1. Specific localities, including Mellieha, Wardija, Kirkop, Dingli, Marsascala, Marsaxlokk, B’Bugia, and Zejtun, will be subject to demand. Parents in these areas may join a waiting list.
7.2. Off We Go Transport Limited reserves the right to adjust pick-up and drop-off times based on daily traffic conditions and route adjustments.
8. Parent Acknowledgment:
- By enrolling in the transport service, parents and guardians acknowledge their responsibility to discuss these rules with their children to ensure compliance. Non-compliance with these rules may result in consequences as stated above.
9. Liability: Off We Go Transport Limited bears sole responsibility for supervising conduct during the journey. Whiz Limited is not liable for any incidents, behavioural issues, or disciplinary actions taken in connection with the transport service.
